Why Bipartisanship Matters

Following a divisive year in politics, speakers at the 2021 virtual REALTORS® Legislative Meetings(link is external)’ Federal Legislative & Political Forum discussed President Joe Biden’s efforts to unify the nation and the legislative outlook for the 117th Congress.

While acknowledging that the political atmosphere is more polarized than ever, CNN political commentator Van Jones and NPR national political correspondent and Fox News contributor Mara Liasson concurred that a middle ground can be found.

“A lot of the change happening in America right now is change a lot of people didn’t sign up for,” Jones said. “We have diversity like you’ve never seen before in the country, technology is changing things, the culture is changing, and change is hard. But we can rise together. No group has to fall for another group to rise.”

Biden ran on a platform of bipartisanship with an intent to manage the big changes happening in the country so they include everyone, said Liasson. The widening economic gap has caused many Americans to favor federal programs that bolster the middle class, she added.

“I can’t think of a president that’s had a more ambitious agenda with a smaller majority in Congress,” said Liasson, who has reported on every presidential election since 1992. She cited his American Jobs Plan and American Families Plan, on top of the American Rescue COVID-19 relief package that passed. “He’s trying to basically put a very large antelope through the python.”

The American Families Plan proposes four years of free education, including universal pre-K and two years of community college, plus childcare support for low- and middle-income families, paid family leave, tax cuts for families with children, and ways to address teacher shortages.

The American Jobs Plan aims to fix highways, bridges, and transit infrastructure, improve drinking water, the eclectic grid, and provide high-speed broadband, as well as rehabilitate more than 2 million homes and commercial buildings.

NAR’s Federal Legislative and Political Forum Chair Matt Silver and Vice Chair Ennis Antoine led the discussion. Antoine pointed out that, as a result of the latest census, Republican red states such as Texas, Florida, and North Carolina will gain congressional seats heading into the next election. Jones said that the reapportionment will make it harder for Democrats to retain their majority in 2022, noting that it’s common for the party of the sitting president to lose seats during the midterm election.

“I think you’re going to see the president push through as much as he can,” Jones said. “I think he has a narrow window to act. He has a very fragile and, in all likelihood, a short-lived majority. And in all likelihood, he’s going to do all he can between now and the midterms.”

Liasson said that Biden may break out pieces of the American Jobs Plan infrastructure package, such as universal broadband or bricks-and-mortar improvements. Such measures would help the U.S. be more competitive with China, and would likely pass with bipartisan votes. Other items could pass the Senate in the reconciliation process, which enables budgetary legislation to pass with 51 votes, rather than a super-majority of 60 votes.

“We’ve had a series of two-year presidencies, [meaning] that because the president tends to lose the majority in Congress in the first midterm, they only have a two-year window to pass their agenda,” Liasson said.

Many of Biden’s proposed programs will benefit Republicans, Liasson pointed out, including “kitchen table” issues such as help with college tuition, childcare reimbursement, and job training. “We’re now so tribalized, so polarized, that the economy doesn’t really matter, and cultural issues tend to be more salient. People tend to vote for their tribe regardless of what they think of the other guy’s policy,” she said.

Jones, who has long pushed for bipartisan policymaking, said the problem with extreme partisanship is that so little gets done, and issues that the majority of Americans care about will go unaddressed. Unfortunately, political incentives make bipartisanship difficult, Liasson added, even though it’s clear many voters support it.

As a long-time proponent of environmental sustainability, Jones advocated to get the Green Jobs Act passed, which was signed into law by President George W. Bush in 2007, and he worked as the green jobs advisor to President Barack Obama. More recently, he worked with Jared Kushner and the Trump White House on the passage of the First Step Act criminal justice reform legislation.

Jones pointed out that police reform has bipartisan support across the country—this includes banning chokeholds while still supporting police interventions, improving addiction and mental health programs, and creating a public registry of crimes police have committed. “There’s a bunch of stuff we agree on. Why don’t we just get together and pass it?” Jones said.

Climate-change action also has bipartisan support, he pointed out, as floods, fires, and droughts continue to affect farmland and other communities across the country. “There isn’t a single Pentagon scenario that doesn’t include climate disruption as a major threat to U.S. interests,” Jones added.

According to an NAR survey, one-third of REALTORS® have assisted buyers in purchasing property with green features in the past year, and 65% of members said promoting energy efficiency in listings is valuable.

Silver asked Jones and Liasson what role NAR should play in climate change discussions.

“REALTORS® can play a massive role in talking about the importance of energy efficiency. That’s the biggest opportunity for job creation,” Jones said. “That energy-efficiency dollar is the hardest working dollar in the economy.”

Investing in updates, such as putting in new insulation, upgrading heating and cooling systems, replacing leaky doors and windows, not only makes a home more efficient, it cuts emissions and bolsters job creation. “It is a triple or quadruple win,” Jones said. “REALTORS® in particular, by using those bipartisan open doors, can talk about the need for the weatherization assistance program and other energy efficiency programs, especially in buildings. It makes good financial and economic sense.”

The Biden administration announces new measures focusing on homeownership and small business development to close racial wealth gaps.

The Biden administration is zeroing in on homeownership and small business development as avenues to close racial wealth gaps, announcing a spate of new programs Tuesday aimed at supporting communities of color and disadvantaged neighborhoods. The announcement comes on the centennial of the “Black Wall Street” massacre in Tulsa, Okla., a racist attack on a thriving Black community that left some 300 dead and thousands homeless in 1921.

The actions the administration will take, according to a White House fact sheet(link is external), include issuing new rules to address bias in the appraisal process, spur production of affordable housing, and encourage greater federal contracts with minority-owned businesses. These moves are meant as a reinvestment in “communities that have been left behind by failed policies,” the fact sheet reads. “Because disparities in wealth compound like an interest rate, the disinvestment in Black families in Tulsa and across the country throughout our history is still felt sharply today.”

The new measures include:

  • Reducing housing discrimination: The Department of Housing and Urban Development will launch a first-of-its-kind interagency effort to address inequity in home appraisals and issue aggressive rules to curb bias in the homebuying process.
  • Spurring infrastructure overhaul: A new $10 billion Community Revitalization Fund to support community-led civic infrastructure projects that create innovative shared amenities, spark new local economic activity, provide services, build community wealth, and strengthen social cohesion. Also, a $15 billion grant program will provide assistance for the planning, removal, or retrofitting of transportation projects that intend to remove barriers to community connectivity.
  • Opening up affordable housing opportunities: A new Neighborhood Homes Tax Credit to attract private investment in the development and rehabilitation of affordable homes for low- and moderate-income home buyers. Additionally, a new $5 billion program called the Unlocking Possibilities Program will provide funding to cities that reduce barriers to producing affordable housing.
  • Supporting minority businesses: The federal government will grow its contracting activity with small, disadvantaged businesses by 50%—an additional $100 billion over five years. Additionally, a new $31 billion investment in small business programs aims to increase access to capital and provide mentoring, networking, and other forms of technical assistance to socially and economically disadvantaged businesses.

The National Association of REALTORS® says the new measures acknowledge the importance of homeownership as a primary means of building wealth and will strengthen fair housing ideals. “The horrific acts of violence and property destruction that occurred in Tulsa 100 years ago, and the subsequent public and private policies that frustrated the recovery of ‘Black Wall Street,’ help illustrate why racial wealth gaps persist in America today,” NAR President Charlie Oppler said in a statement Tuesday.

Oppler said NAR will play a role in helping to shape the Biden administration’s housing priorities: “NAR is particularly encouraged by the administration’s most recent efforts to address inequities in the home appraisal process, and we support a thorough review of the current appraisal system alongside both public and private stakeholders. We look forward to working with the White House and HUD on other upcoming rulemakings that seek to more effectively combat housing discrimination and redress the legacy of residential racial segregation.”

NAR Ad Campaign Recognized for Fair Housing Commitment

The National Association of REALTORS®’ fair housing campaign, “The Fight for Fair,” speaks out against all forms of discrimination in housing and emphasizes the association’s commitment to fair housing. The campaign—which declares “fairness is worth fighting for, and we won’t stop until the fight is won”—has been recognized for its messaging with several awards recently.

“The Fight for Fair” nabbed a Gold award in the real estate category of the Shorty Awards(link is external), which honors top content creators and producers on social media. It also has won two BrandSmart awards from the American Marketing Association, a Gold for Cause Marketing and the Grand Champion Award. “The Fight for Fair” has also won a Gold Stevie Award for Marketing Campaign of the Year in the real estate category from the American Business Awards, and has won a Silver from the American Advertising Awards Chicago Chapter.

“The widespread recognition that NAR’s consumer advertising campaign continues to receives is a testament to the work authentically reflecting our members’ tireless work in partnership with their clients and consumers across America,” says Victoria Gillespie, NAR’s chief marketing and communications officer. “REALTORS® abide by a strict Code of Ethics and fair housing is a key tenet of our code. ‘The Fight for Fair’ acknowledges the unfortunate reality we continue to face in this country as we strive to ensure the American dream of property ownership is accessible to everyone.”

Another Chance to Defend Independent Contractor Status

A U.S. Senate committee held a hearing Thursday on the proposed Protecting the Right to Organize Act, which targets the independent contractor status of millions of Americans. The National Association of REALTORS® vowed that even though parts of the bill face steep resistance on Capitol Hill, the NAR advocacy team will remain vigilant and engaged with lawmakers on the issue.

“As long as this bill is active, we will work to include language protecting existing state definitions of ‘employer’ and ‘employee’ and ensure our industry is protected,” says Shannon McGahn, NAR’s chief advocacy officer. “Around 87% of NAR’s 1.4 million members are independent contractors, most of whom choose this classification. Congress must recognize real estate’s unique place in the economy and support this longstanding federal recognition.”

Earlier this year, NAR urged members not to panic over the legislation.  Contrary to a report at the time, the PRO Act is not and never has been close to imminent passage in the Senate.

In recent months, NAR has intensified its ongoing educational campaign highlighting how crucial the independent contractor classification is to the real estate industry. NAR’s advocacy team argues that provisions in the PRO Act should not apply to real estate professionals, and bipartisan support for a real estate–specific exemption remains consistent. While securing the 60 votes needed to advance the legislation through the Senate is unlikely, McGahn notes that lawmakers have other avenues to push the legislation forward. “NAR is confident in our position, but we are not letting our guard down given the stakes,” McGahn says. “We raised this issue during our May legislative meetings with more than 500 members of Congress. It was one of our top three legislative priorities this year.”

HUD Allocates $47M to Fight Housing Discrimination

The U.S. Department of Housing and Urban Development is distributing $47.4 million to housing organizations to help promote fair housing nationwide—new funding the National Association of REALTORS® has been advocating for to combat housing discrimination. The grants are being awarded to 120 national and local fair housing organizations.

“The fair housing groups HUD funds are a critical piece of combating housing discrimination,” said Jeanine Worden, HUD’s acting assistant secretary for fair housing and equal opportunity. The new grants would enable 120 fair housing groups to combat housing practices that violate the Fair Housing Act, she said.

The grants will go toward numerous fair housing efforts, including investigating and litigating fair housing complaints, testing to identify discrimination in the rental and sales markets, educating the public and housing providers about the Fair Housing Act, and building on processes and outreach of nonprofit fair housing organizations, particularly those focusing on the rights of underserved populations, including rural and immigrant populations.

NAR has long advocated for additional funding for HUD’s fair housing enforcement and education efforts. “As stewards of the right to own, use, and transfer private property, our livelihoods and businesses as REALTORS® depend upon an open housing market free from discrimination,” NAR has noted in lobbying on Capitol Hill for an increase in funds for these purposes. “NAR is firmly committed to the enforcement of fair housing laws.”

Also with the goal of promoting fair housing, the Federal Housing Finance Agency announced on Tuesday that Fannie Mae and Freddie Mac will submit equitable housing finance plans to the agency by the end of the year. These plans, which will be updated annually, will identify and seek to address barriers to sustainable housing opportunities. The FHFA will also require Fannie Mae and Freddie Mac to submit annual progress reports on the action they take on the plans. Read more at FHFA.gov(link is external).

“For generations, discriminatory practices like redlining have prevented communities of color from building wealth through homeownership,” said Sandra L. Thompson, the FHFA’s acting director. “By identifying the barriers to equitable and sustainable housing finance opportunities and setting goals for addressing those barriers, the Enterprises, consistent with safety and ​soundness, can responsibly reduce the racial and ethnic disparities in homeownership and wealth that still exist today.”

Give Buyer Clients Solid Reasons to Skip Love Letters

NAR’s new “Window to the Law” video exposes the red flags buyers’ notes to sellers can raise in a transaction.

The National Association of REALTORS® is continuing to warn its members about the use of buyer love letters to help their clients’ offers stand out from the competition. The letters buyers write to emphasize their desire for a home, in which they often share personal details, are raising fair housing red flags. They can also create potential legal risks for the real estate broker.

That’s why states such as Oregon have banned such buyer letters in transactions. In July, Oregon became the first state to enact a law specifying that seller’s agents must reject buyers’ letters to sellers that contain information outside of the traditional offer.

“The use of a love letter often presents fair housing issues because they often contain personal information about the buyer, such as their race and culture or traditions as a way of appealing to the seller’s emotions,” Charlie Lee, NAR’s senior counsel and director of legal affairs, said during a “Window to the Law” video. “Some buyers even go as far as sending sophisticated packages that include photographs and videos.”

In the latest Window to the Law video, produced by NAR’s legal team, Lee shares various scenarios that could be especially problematic if a buyer shared such information in a letter, such as even including a photo of the family around a Christmas tree.

Lee encouraged real estate professionals to speak to their clients about the risks of buyer love letters and the potential fair housing issues they can raise. Real estate professionals should avoid helping their buyers draft them.

As for seller clients, Lee said they should be instructed to view an offer objectively on pricing and timing. If they insist on receiving buyer love letters, Lee advises real estate pros to urge them to consult legal counsel and to document the seller’s decision-making process in selecting an offer.

NAR Files Petition Opposing Department of Justice Action

The National Association of REALTORS® today filed a petition in federal district court in Washington, D.C., to quash a U.S. Department of Justice request that reneges on the terms of a settlement agreement. The agreement, focused on various multiple listing service policies, was approved by the Justice Department in November 2020. In a news release issued today, NAR called the department’s attempt to withdraw from the agreement—after NAR had already begun to implement its terms—“a breach of the agreement and the law.”

NAR’s guidance for MLSs has long been recognized by courts as fostering fair and competitive real estate markets for home buyers and sellers. Having buyer brokers’ compensation come from the listing broker’s commission “increases competition by allowing small brokerages to compete on a level playing field with large brokerages and promotes equitable homeownership opportunities for all consumers,” the association said in today’s release.

NAR President Charlie Oppler, a CEO of Prominent Properties Sotheby’s International Realty, Franklin Lakes, N.J., said, “The DOJ action should be considered null and invalid based on legal precedent alone. The DOJ must be governed by principle, and NAR simply expects the department to live up to its commitments.”

Oppler said NAR remained committed to “advancing and defending independent and local real estate organizations that provide for greater economic opportunity and equity for small businesses and consumers of all backgrounds and financial means.”
